Medical Malpractice

Numerous studies have determined that medical malpractice is one of the leadings causes of death in the United States. While not every unsuccessful outcome from medical treatment is malpractice, when a patient is injured because a doctor failed to follow the appropriate procedures (also known as the "standard of care"), the patient may have a malpractice action. Each procedure has its own standard of care, so what may be appropriate for some procedures would not be reasonable for others. In addition, a patient's special medical needs should be considered by the doctor to make certain that the suggested treatment will not affect a different pre-existing medical condition. The same legal concept applies to all medical providers, including doctors, dentists, nurses, physical therapists and others.
